Terms and Conditions

NOTICE: BIDDING CONSTITUTES A LEGAL AGREEMENT TO PURCHASE. PLEASE READ CAREFULLY.

By registering for an auction and/or placing a bid in any Eastside Estate Liquidation auction, you acknowledge that you have read, understand, and agree to the following Terms and Conditions.

1. Binding Obligation to Purchase

Placing a bid constitutes a contractual commitment to complete the purchase. If you are the winning bidder, you are responsible for payment in full and for collecting your item(s) during the designated pick-up period or completing any approved shipping arrangements.

Do not bid unless you fully intend to complete the purchase and are able to meet the applicable pick-up or shipping requirements.

Once placed, bids may not be retracted or canceled except at Eastside Estate Liquidation's sole discretion or as otherwise required by applicable law.

2. Pick-Up and Shipping Responsibility

Winning bidders must:

  • Pick up their items during the designated pick-up window listed for the auction or on the invoice; or

  • Make approved shipping arrangements before the scheduled pick-up date.

Eastside Estate Liquidation is not responsible for loading, disassembly, packing, moving, or transporting purchased items unless expressly stated otherwise.

Items may be located on upper or lower floors, in garages, outbuildings, storage areas, or other locations requiring additional physical effort or equipment. Buyers are solely responsible for bringing adequate labor, tools, packing materials, vehicles, and equipment necessary to safely remove their purchases without damaging the property or other items.

When shipping is requested or arranged, the buyer is responsible for all applicable shipping, handling, packing, insurance, and related charges unless otherwise expressly agreed in writing.

3. Missed Pick-Up and Abandoned Items

Items not collected during the designated pick-up period, and for which no approved shipping or alternate arrangement has been made, may be considered abandoned.

Abandoned items may be resold, donated, discarded, or otherwise disposed of at Eastside Estate Liquidation's discretion, without refund to the buyer.

Alternate or late pick-up arrangements are not guaranteed. If an alternate pick-up is approved at Eastside Estate Liquidation's sole discretion, additional handling, access, storage, or administrative fees may apply.

4. Invoices and Payment Deadline

Invoices are emailed following the conclusion of the auction.

If the payment method on file is declined, payment in full must be received by 7:00 p.m. on the day following the auction's close.

Failure to make payment by the deadline may result in forfeiture of the purchased items and suspension or permanent revocation of bidding privileges.

5. ALL ITEMS SOLD AS IS, WHERE IS — NO GUARANTEES OR WARRANTIES

ALL ITEMS ARE SOLD AS IS, WHERE IS, WITH ALL FAULTS, WHETHER KNOWN OR UNKNOWN.

Unless expressly stated otherwise in writing, Eastside Estate Liquidation makes no representations, warranties, or guarantees, express or implied, regarding any item, including but not limited to:

  • Condition, quality, completeness, or functionality

  • Authenticity, attribution, provenance, or origin

  • Age, date, period, or history

  • Manufacturer, maker, artist, designer, brand, or model

  • Materials, composition, metal content, gemstone identification, or fineness

  • Dimensions, measurements, weight, quantity, or size

  • Rarity, collectibility, desirability, or market value

  • Fitness for a particular purpose or intended use

  • Working, mechanical, electrical, or operational condition

Descriptions, photographs, measurements, markings, dates, maker identifications, material identifications, and other information contained in auction listings are provided for general identification and informational purposes only.

Such information represents Eastside Estate Liquidation's good-faith observations and opinions based upon information reasonably available at the time of listing and does not constitute a warranty, guarantee, certification, professional authentication, or appraisal.

Photographs are considered part of the item description; however, photographs may not depict every flaw, defect, repair, alteration, missing component, sign of wear, or other condition issue.

Differences in lighting, photography, screens, displays, and viewing conditions may affect the appearance of color, finish, texture, size, and other characteristics.

The absence of a condition issue from a description or photograph does not mean that the item is free from defects, damage, wear, repairs, alterations, missing components, or other condition concerns.

6. Bidder Responsibility

Bidders are responsible for carefully reviewing all photographs, descriptions, measurements, markings, and other information available in the listing before placing a bid.

Eastside Estate Liquidation is not an authentication, appraisal, grading, or certification service.

Statements regarding an item's identity, authenticity, age, origin, provenance, materials, maker, artist, designer, manufacturer, condition, functionality, or value represent good-faith observations or opinions based upon information reasonably available to us.

If authenticity, condition, age, materials, functionality, provenance, value, or any other characteristic is important to a bidder's purchasing decision, it is the bidder's responsibility to ask questions and obtain any additional information they require before bidding.

By placing a bid, the bidder acknowledges that they have reviewed the information provided, are relying upon their own evaluation and judgment, and accept the risks inherent in purchasing used, vintage, antique, collectible, estate, and other merchandise through an online auction.

Placing a bid constitutes acceptance of the item under the AS IS, WHERE IS and final-sale provisions contained in these Terms, except where otherwise required by applicable law.

7. ALL SALES ARE FINAL — NO RETURNS OR REFUNDS

ALL SALES ARE FINAL. EASTSIDE ESTATE LIQUIDATION DOES NOT ACCEPT RETURNS.

Except where otherwise required by applicable law, there are NO RETURNS, REFUNDS, EXCHANGES, CREDITS, CANCELLATIONS, OR PRICE ADJUSTMENTS for any reason, including but not limited to:

  • Condition, damage, wear, or completeness

  • Authenticity, attribution, or provenance

  • Age, date, period, or origin

  • Manufacturer, maker, artist, designer, brand, or model

  • Materials, composition, metal content, gemstones, or fineness

  • Dimensions, measurements, weight, quantity, or size

  • Functionality or working condition

  • Rarity, collectibility, desirability, or market value

  • Buyer's remorse or change of mind

  • Failure to adequately review photographs, descriptions, measurements, or other listing information before bidding

A buyer's dissatisfaction with an item or disagreement with a description, identification, attribution, opinion, or other information provided in a listing does not create a right to return the item or receive a refund, exchange, credit, cancellation, or price adjustment.

A 15% Buyer's Premium and applicable sales tax will be added to the final invoice.

Sales tax will be waived only when valid resale documentation has been provided and verified in accordance with applicable requirements.

8. Authenticity, Attribution, Condition, and Post-Sale Claims

Eastside Estate Liquidation is not an authentication, appraisal, grading, or certification service.

Descriptions and identifications are provided in good faith for general informational purposes based upon information reasonably available to us.

No statement regarding authenticity, maker, artist, manufacturer, age, period, materials, origin, provenance, condition, functionality, value, or other characteristic constitutes a warranty, certification, professional authentication, or guarantee.

A claim or allegation made after the sale regarding authenticity, attribution, condition, materials, age, origin, provenance, functionality, value, or another characteristic does not, by itself, create a right to return merchandise or receive a refund, exchange, credit, cancellation, or price adjustment.

If a buyer believes there is a legal issue concerning a transaction, the buyer must promptly notify Eastside Estate Liquidation in writing and provide supporting information.

Such notification does not constitute authorization to return merchandise and does not alter the final-sale nature of the transaction.

Eastside Estate Liquidation does not authorize buyers to return merchandise simply because an authenticity concern, condition concern, disagreement with a listing, chargeback, or other payment dispute has been raised.

Nothing in these Terms limits any right or remedy that cannot lawfully be waived under applicable law.

9. Previously Sealed, Unopened, or Original-Packaging Items

If an item is sold as sealed, unopened, unused, new-old-stock, factory-packaged, or otherwise in intact original packaging, that condition is considered a material characteristic of the item at the time of sale.

Once a buyer opens, unseals, cuts, breaks, removes, damages, alters, or otherwise disturbs an original seal, wrapper, package, closure, label, security feature, or other component establishing the item's unopened condition, the buyer has materially changed the condition of the merchandise.

Opening or disturbing a previously sealed or unopened item may permanently affect its condition, collectibility, evidentiary characteristics, and market value.

A buyer who opens, unseals, dismantles, alters, tests, modifies, or otherwise materially changes an item after receiving it accepts responsibility for that change in condition and any resulting change in value.

Opening an item does not create a right to a refund based upon information discovered after opening it.

Any concern regarding the authenticity, condition, contents, or other characteristics of an item sold as sealed or unopened should be raised before the original sealed or unopened condition is disturbed.

Photographs, video, listing records, packaging records, seals, labels, identifying characteristics, measurements, weights, and other documentation may be used to establish the item's condition before shipment or release.

10. Item Identity, Alteration, Tampering, and Substitution

Eastside Estate Liquidation may document merchandise before pick-up or shipment through photographs, video, measurements, weights, serial numbers, identifying characteristics or markings, packaging records, shipping records, or other reasonably appropriate means.

After merchandise has been released to, picked up by, or delivered to the buyer, the buyer is responsible for maintaining its identity, condition, integrity, and security.

Substitution, reproduction, counterfeiting, alteration, modification, tampering, removal or replacement of components, or falsely representing another item as merchandise originally purchased from Eastside Estate Liquidation is strictly prohibited.

Eastside Estate Liquidation may use photographs, video, measurements, weights, markings, serial numbers, identifying characteristics, packaging documentation, shipping records, and other evidence to establish the identity and condition of merchandise at the time it left Eastside Estate Liquidation's possession or control.

The presentation, shipment, or delivery of merchandise back to Eastside Estate Liquidation does not constitute acceptance of a return and does not create an obligation to issue a refund, credit, exchange, cancellation, or other adjustment.

Eastside Estate Liquidation reserves all rights and remedies available under applicable law if merchandise is substituted, altered, reproduced, tampered with, materially changed, misrepresented, or otherwise involved in suspected improper conduct.

11. Shipping, Delivery, and Transfer of Possession

When merchandise is shipped, Eastside Estate Liquidation may photograph or otherwise document the merchandise, its identifying characteristics, condition, and packaging before shipment.

Documentation may include photographs, video, measurements, weights, serial numbers, identifying marks or characteristics, packaging records, carrier records, tracking information, package weights, delivery confirmation, and signature confirmation.

Upon confirmed delivery, the buyer assumes responsibility for the possession, custody, security, and preservation of the merchandise, subject to applicable law.

Apparent shipping damage should be promptly documented. Buyers should retain the merchandise, exterior shipping container, interior packaging, shipping labels, and other shipping materials necessary for any applicable carrier or insurance claim.

Shipping damage must be distinguished from an item's preexisting condition and from any alteration, damage, opening, modification, or other change occurring after delivery.

12. Chargebacks and Payment Disputes

A CHARGEBACK OR PAYMENT DISPUTE DOES NOT CONSTITUTE A RETURN, CANCELLATION, OR REFUND AND DOES NOT ALTER THE FINAL-SALE TERMS OF THE AUCTION.

Eastside Estate Liquidation reserves the right to contest chargebacks and payment disputes and to provide relevant documentation to payment processors, financial institutions, auction platforms, insurers, legal counsel, law enforcement, or other appropriate parties as permitted by law.

Such documentation may include:

  • The buyer's acceptance of these Terms and Conditions

  • Registration and bidding records

  • Invoices and payment records

  • Communications with the buyer

  • Auction photographs and descriptions

  • Pre-shipment photographs and video

  • Identifying characteristics, markings, serial numbers, measurements, and weights

  • Packing and shipping documentation

  • Carrier tracking and package-weight records

  • Delivery and signature confirmation

  • Pick-up records

  • Other evidence relevant to the identity, condition, shipment, delivery, or possession of the merchandise

Initiating a chargeback or payment dispute does not authorize a buyer to retain merchandise without payment, return merchandise without authorization, substitute different merchandise, or alter, reproduce, dismantle, modify, remove components from, or tamper with purchased merchandise.

If a financial institution, payment processor, court, or other legally authorized entity requires merchandise to be surrendered or returned as part of resolving a dispute, the merchandise must be the exact merchandise originally purchased and delivered, without substitution, alteration, reproduction, removal or replacement of components, tampering, or other material change by the buyer, except to the extent otherwise required by applicable law.

Eastside Estate Liquidation reserves all rights and remedies available under applicable law regarding nonpayment, unauthorized retention of merchandise, material misrepresentation, substitution, alteration, tampering, or other improper conduct.

13. Acceptance of Terms

By registering and/or placing a bid, the bidder acknowledges that they have had the opportunity to review the applicable item listing and these Terms and Conditions before bidding and agree to be bound by them.

It is the bidder's responsibility to ask questions before placing a bid.

A bid should not be placed when the bidder requires certainty regarding an item's condition, authenticity, attribution, age, provenance, materials, functionality, contents, value, or other characteristic that has not been independently verified.

IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, DO NOT PLACE A BID.
